Backgrounder:
Studying the specific law develops one’s understanding of the levers of power in the system in a way that is even more effective than the basic training provided for a departmental position. This is because the law is directly concerned with power and reaches into every part of your job and decision-making process. For that very reason studying the fundamentals of theory and practicality of law is extraordinarily important to a decision-making officer at any level within the department.
The department offers a basic training to handle files, mostly based on procedures and manuals and ministerial instructions, all of which are subject to change from time to time. On the other hand, examining any Immigration file and rendering a decision is considered a federal or provincial decision made by the Government agent who could be challenged in the tribunal or court of law having federal or provincial jurisdiction.
To face the challenge in an appeal, one needs more than a basic knowledge concerning respect for the law, the authoritative force, examination and enforcement procedure, and how it is applied and processed through the Canadian justice system.
Studying law in greater depth offers a wonderful intellectual challenge and is also an investment, in that it develops the ability to argue from a basis of evidence in a way which can be very hard for non-lawyers to counter.
